Terms of Service

These Terms and Conditions govern the use of services provided by KFN Media (“we”, “us”, “our”). By accessing or using our services, website, or digital systems, you agree to be bound by these terms.

KFN Media provides digital services including web development, software engineering, hosting, automation systems, AI integration, SEO services, consulting, and related digital solutions for organisations.

Our services are intended for business and organisational use only. By using our services, you confirm that you are authorised to act on behalf of a business or organisation.

We provide digital services based on agreements, proposals, or written communication. The scope of each project is defined individually. Any work outside the agreed scope may incur additional charges.

This includes web hosting, managed WordPress, cloud, AI, consulting and development services as set out in the applicable order and service-specific policies.

1. Introduction

KFN Media (“we”, “us”, “our”) operates a digital cloud store providing access to third-party software, cloud services, licenses, subscriptions, and digital products (“Products”).

We act as a reseller and intermediary platform, facilitating the purchase and delivery of services provided by independent third-party vendors (“Vendors”), including but not limited to software companies, cloud infrastructure providers, and SaaS platforms.

By using our services or purchasing Products, you agree to this Cloud Store Legal System.

2. Marketplace Model

KFN Media is not the manufacturer, owner, or primary provider of the Products listed in our store.

We operate as an intermediary platform that:

• Lists third-party Products
• Facilitates payment and delivery
• Provides customer support for purchase-related issues

All Products are ultimately owned, controlled, and licensed by their respective Vendors. Each Vendor may have its own terms, licensing rules, privacy policies, and usage restrictions which apply in addition to this agreement. In the event of conflict between Vendor terms and KFN Media terms, Vendor terms relating to product usage and licensing shall prevail.

3. Third-Party Vendors and Brands

Products may include services from vendors such as Microsoft, GoTo, Automattic, AvePoint, Adobe and other cloud or software providers.

All trademarks, brand names, and logos are the property of their respective owners.

KFN Media:

• Does not claim ownership of third-party products
• Is not affiliated with or endorsed by any Vendor unless explicitly stated
• Acts only as a reseller or facilitator of access

4. Product Delivery and Fulfillment

Products are delivered digitally via email, account activation, dashboard access, or direct vendor provisioning.

Delivery timelines may depend on Vendor processing times, license validation, payment verification, and system or API availability. KFN Media is not responsible for delays caused by third-party Vendors or infrastructure providers.

5. Licenses and Usage Rights

All Products are subject to Vendor licensing terms. Unless explicitly stated otherwise, licenses are non-transferable, usage is limited to the terms defined by the Vendor, and activation and account usage are controlled by the Vendor. KFN Media does not grant independent usage rights beyond what is provided by the Vendor.

6. Pricing and Payments

All prices are listed in applicable currency and may change without prior notice. Payments must be completed before Product delivery or activation. We reserve the right to refuse or cancel orders, hold orders for fraud or verification checks, and adjust pricing due to Vendor changes. Some Products may be fulfilled directly by Vendors after purchase.

7. Refund Policy (Strict Digital Goods Rule)

Due to the nature of digital Products:

• No refunds are issued once a license key, activation, or access has been delivered
• No refunds for used, activated, or redeemed Products
• Refunds are only possible if a Product is proven invalid and cannot be replaced
• Refund eligibility is subject to Vendor confirmation where applicable

Chargebacks or payment disputes may result in account suspension.

8. Vendor Liability Disclaimer

KFN Media is not responsible for Vendor service outages or downtime, license revocation or suspension by Vendors, changes in Vendor pricing or product availability, restrictions imposed by Vendors on accounts or services, or failure of Vendor APIs, systems, or infrastructure. All responsibility for Product performance lies with the respective Vendor.

9. No Guarantee of Continuity

We do not guarantee continuous availability of any Product, permanent access to any license or subscription, or long-term stability of Vendor services. Products may change, update, or be discontinued by Vendors at any time.

10. Acceptable Use Policy

Users agree not to use Products for illegal or fraudulent activities, attempt to reverse engineer, resell, or redistribute licenses, abuse Vendor systems or bypass restrictions, or engage in fraudulent purchases or chargeback abuse. We reserve the right to suspend or terminate access for violations.

11. Fraud and Risk Management

We reserve the right to cancel suspicious transactions, request identity or payment verification, block access to Products in case of suspected fraud, and report fraudulent activity to payment providers or authorities.

12. Limitation of Liability

To the maximum extent permitted by law, KFN Media shall not be liable for any indirect or consequential damages, loss of profits, revenue, or data, service interruptions or Vendor failures, or business losses arising from Product use. Total liability shall not exceed the amount paid for the specific Product.

13. Data Protection and Privacy

Data is processed in accordance with applicable data protection laws, including GDPR where applicable. We collect only necessary data for order processing, delivery of Products, customer support, and fraud prevention. For full details, refer to our Privacy Policy.

14. Termination

We may suspend or terminate access to the store if terms are violated, fraud is detected, payments are disputed, or required by law or Vendor instruction.

15. Force Majeure

We are not liable for failure or delay caused by events beyond our control, including cloud outages, cyberattacks, Vendor system failures, natural disasters, and government actions.

16. Governing Law

This agreement is governed by the laws of Sweden. Any disputes shall be resolved in Swedish courts unless otherwise required by mandatory law.

We do not guarantee specific outcomes including but not limited to revenue, traffic, search engine rankings, system performance, or business growth. All services are provided on a best-effort professional basis.

Clients are responsible for providing accurate, complete, and timely information, approvals, content, and access required for service delivery. Delays in client input may result in project delays without liability on our side.

All payments must be made according to agreed terms. Invoices must be paid by the due date stated. Late payments may result in suspension or termination of services. Payments are generally non-refundable unless otherwise agreed in writing.

Due to the nature of digital services, refunds are not provided for work already started or delivered. Refunds may only be issued at our discretion or where required by law.

All proprietary systems, frameworks, code, designs, workflows, and internal tools developed by KFN Media remain our intellectual property unless explicitly transferred in writing. Clients retain ownership of their own content and materials.

Upon full payment, clients are granted a limited, non-exclusive, non-transferable license to use delivered work for its intended purpose. Redistribution, resale, or replication of our systems is not permitted unless agreed.

Disclaimer: This license applies only to development, design, software, and custom work delivered by KFN Media. It does not apply to third-party store products (software, licenses, subscriptions, or SaaS) purchased through our cloud store, which are governed by the Third-Party Store Disclaimer below and the applicable vendor terms.

Both parties agree to keep confidential all non-public information shared during the course of the business relationship. This obligation continues after termination of services.

We may use third-party providers such as hosting services, APIs, cloud infrastructure, and payment processors. We are not responsible for failures, downtime, or issues caused by third-party systems.

We aim to provide reliable services but do not guarantee uninterrupted availability. Maintenance, updates, or external failures may cause temporary disruptions.

You agree not to use our services for illegal, harmful, abusive, or fraudulent activities. This includes hacking, malware distribution, spam, unauthorized access, or system interference.

We reserve the right to suspend or terminate services immediately if there is breach of these terms, non-payment, abuse, or illegal activity.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages including loss of profit, data, revenue, or business opportunities. Our total liability is limited to the amount paid for the service in question.

You agree to indemnify and hold KFN Media harmless from any claims, damages, losses, or expenses arising from misuse of services, breach of terms, or violation of applicable laws.

We are not responsible for delays or failure caused by events beyond our control, including cyberattacks, natural disasters, internet outages, government actions, or infrastructure failures.

We may update these Terms and Conditions at any time. Updated versions will be published on our website and take effect immediately.

These Terms and Conditions are governed by the laws of Sweden. Any disputes shall be handled by Swedish courts unless otherwise required by mandatory law.
